German Investors Buying Dubai Property: What to Know in 2026

Dubai is popular with German investors, but there is no Germany-UAE double tax treaty in force. Here is what that means for rent, resale, reporting and buying from Germany.

German buyers are a familiar presence in Dubai's property market, drawn by newer housing, freehold ownership and the absence of UAE income tax on individuals. But for German investors buying Dubai property, the German side of the equation matters just as much as the Dubai side. There is currently no double tax treaty between Germany and the UAE, and German rules on rental income, losses and resale apply in full. This guide sets out the basics.

Can Germans buy property in Dubai?

Yes. German citizens can buy freehold property in Dubai's designated freehold areas with full ownership, whether off-plan or ready. There is no requirement to live in the UAE. Our guide can foreigners buy property in Dubai? explains the freehold system.

The key fact: no double tax treaty

The Germany-UAE double tax agreement expired on 31 December 2021, and no replacement has entered into force. As reported by Steuer-Berater.de in October 2026, the two governments have expressed their intention to conclude a new treaty soon, but it is not yet in force and its terms are not settled.

What that means in practice, as Germany Trade & Invest (GTAI) explains: Germany relies on its own unilateral rules, and because the UAE does not levy the relevant tax, there is nothing to credit. UAE-source income of a person with unlimited German tax liability is therefore generally taxable in Germany.

Rental income from Dubai

If you are resident in Germany (unbeschränkt steuerpflichtig), rent from your Dubai property is generally taxable as income from letting and leasing (Vermietung und Verpachtung, Paragraph 21 EStG), at your personal income tax rate.

Typical deductible costs (Werbungskosten) include:

  • Service charges you pay as owner (not recharged to the tenant)
  • Property management and letting fees
  • Repairs and maintenance
  • Loan interest
  • Depreciation (AfA) on the building under Paragraph 7 EStG

Ask your Steuerberater which depreciation rate and method apply to your specific Dubai property.

Losses: the Paragraph 2a trap

The UAE is a third country (outside the EU and EEA). Under Paragraph 2a EStG, losses from renting third-country property cannot be offset against your other German income. As JUHN Partner explains, they can only be set against future positive income of the same type from the same country. So if high initial costs create a rental loss in the first years, that loss will not reduce your German salary tax. Plan your financing and expectations accordingly.

Selling: the 10-year rule

Under Paragraph 23 EStG, a gain on selling private real estate is generally taxable if less than ten years pass between purchase and sale. After ten years, a private sale is generally tax-free. ImmoScout24 notes that the property's location does not matter, so the rule applies to foreign property just as it does to German property.

Points to check with your adviser:

  • Start of the period: generally the date of the binding purchase contract. For off-plan purchases, confirm which date counts.
  • Own use: gains may be tax-free within ten years if you used the property yourself as a residence, under specific conditions.
  • Commercial dealing: selling more than three properties within five years can be treated as commercial property dealing (gewerblicher Grundstückshandel), with different tax consequences.

Reporting payments to the Bundesbank

German residents making large cross-border payments must report them under the Foreign Trade and Payments Regulation (AWV). According to Börsen-Zeitung, the rules changed from the January 2025 reporting month:

RuleCurrent position
Reporting thresholdPayments above 50,000 euros (previously 12,500 euros)
Who reportsThe account holder, not the bank
DeadlineBy the 7th working day of the following month
Private individualsCovered; can report by phone
PenaltiesFines of up to 30,000 euros per violation

An off-plan instalment or a ready purchase price will often exceed this threshold, so each qualifying transfer should be reported.

Inheritance and gift tax

German inheritance and gift tax can extend to foreign assets where the deceased, the donor or the heir is resident in Germany. With no treaty in place, plan Dubai property succession carefully, and consider a will that is recognised in Dubai. Our guide to wills and inheritance for Dubai property owners covers the Dubai side.

Buying from Germany, step by step

Most of the purchase can be handled from Germany:

  1. Video viewings and due diligence on the developer or the unit.
  2. Electronic signing of reservation forms and, for off-plan, the sale and purchase agreement.
  3. Payments by transfer to the project escrow account (remember the AWV report).
  4. Power of attorney for a resale transfer if you cannot attend. Under DLD Circular 29/R/2025, a POA signed in Germany must be notarised, legalised by the UAE embassy or consulate, attested by the UAE Ministry of Foreign Affairs and translated into Arabic.

Practical details

  • Time difference: Dubai is 3 hours ahead of Germany in winter and 2 hours ahead in summer.
  • Currency: the dirham is pegged to the US dollar, so euro investors carry EUR/USD exchange rate risk on both price and rent.
  • Residency: property worth AED 2 million or more can support a 10-year Golden Visa.

Frequently asked questions

Is there a double tax treaty between Germany and the UAE?

Not currently. The previous treaty expired on 31 December 2021. As of October 2026, the two countries had signalled intent to agree a new treaty, but none was in force.

Do German residents pay tax on Dubai rental income?

Generally yes. German residents are taxed on worldwide income, and with no treaty in force and no UAE income tax on individuals, Dubai rent is usually taxed in Germany as rental income.

Is selling Dubai property tax-free for Germans after 10 years?

Under Paragraph 23 EStG, gains on private property sales are generally taxable if bought and sold within ten years and generally tax-free after that. The rule applies to foreign property as well; exceptions and the commercial dealing test should be checked with an adviser.

Do I need to report my Dubai property payment to the Bundesbank?

Since January 2025, cross-border payments above 50,000 euros must generally be reported to the Deutsche Bundesbank under the Foreign Trade and Payments Regulation, usually by the 7th working day of the following month.
